Limebooth™ reserves the right to immediately terminate your account without further notice in the event that, in its judgment, you violate these rules, the Terms of Service or our other policies.

Video upload:

You need to be part of the performance in every video you upload, or download from another website.
Keep Limebooth™ clean, don' t upload the same videos twice , or don’t upload videos with only a few seconds of play time.

Impersonation:

You may not impersonate others through our services.

Privacy:

You may not publish or post other people's videos or personal information, such as credit card numbers, street address or Social Security/National Identity numbers, without their express authorization and permission.

Violence and Threats:

You may not publish or post direct, specific threats of violence against others.

Hate Speech:

You may not publish or post material that promotes hate toward any groups based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity.

Copyright:

We will respond to clear and complete notices of alleged copyright infringement. Our copyright procedures are set forth in the Terms of Service and Copyright policy.

Unlawful Use:

You may not use our service for any unlawful purposes or for promotion of illegal activities.

Serial Accounts:

You may not create serial accounts or relationships in order to evade the block tools or to otherwise disrupt the Services.

Name Squatting:

You may not engage in name-squatting (creating accounts for the purpose of preventing others from using those account names or for the purpose of selling those accounts).

Links:

You may not publish or post content that disguises the content of a link in a misleading or deceptive way.

Malware/Phishing:

You may not publish or link to malicious content intended to damage or disrupt another user's browser or computer or to compromise a user's privacy.

Social Network Spam:

Limebooth™ provides a variety of ways for users to interact with one another. 
You may not abuse these tools for the purpose of spamming users. Accounts that are marked as spam will be removed without further notice.

False or Obscene:

You may not publish, post or transmit content that is knowingly false or misleading, or obscene or pornographic.

Harassment:

You may not publish or post content with the intent to harass or to advocate the harassment of another person.

WARNING: Our users are important to us. Breaking the general site rules will result in immediate termination of your account without notification.

1.   Object of the user’s agreement

This user’s agreement contains the terms and conditions applicable to the use of the information and services provided by Limebooth BVBA on the website limebooth.com. By merely using the site and the services offered on the site, you shall be deemed to have accepted the terms and conditions of this user’s agreement.

 2.   Intellectual property

Information and content you put on the site

You own all the content and information you post on Limebooth.com. Limebooth™ wishes to respect the intellectual property rights of the content on its website. Accordingly, the following rules shall apply:

  • For content that you provide and that is covered by intellectual property rights (e.g. photos, lyrics and videos),  you grant us a free, worldwide and non-exclusive license to use this sort of content within the context of our site. This license ends when you delete this content or when you remove your account. However, when deleting content or your account, it may persist in backup copies for a reasonable period of time. These backups, and the content it possesses, will not be available to others.
  • If you post material (audio, audio-visual, photos, texts, etc.) on our website, you shall bear exclusive responsibility for obtaining all the authorisations from the proprietors (copyright and related rights, personality rights) or you will use your material under an open, flexible copyright (e.g. material under Creative Commons licence).
  • When the work that you wish to post on the website is not your own creation or if it was created by several people, you shall bear exclusive responsibility to contact every party who cooperated in the recording or the work beforehand (people who cooperated in the work or the recording, people who are depicted and the parties who obtained rights after the creation (record company, publisher, etc.)).
  • When you use our profile plugins (Soundcloud & Twitter), you grant us access to your content on these third party applications or websites. You consent that we may make this content or information available to the visitors of your profile. You should always review the policies of third party applications and websites to make sure you are comfortable with the ways in which they share your information (cf. Twitter Soundcloud). Providing false information or using these plugins to make content available that isn't yours is not allowed and infringes with intellectual property rights.
  • By connecting your Limebooth™ account to your Facebook, Twitter or YouTube account, you grant us permission to do certain actions on these platforms acording to your settings. Limebooth™ will never act on your behalf without your permission. You should always review the policies of third party applications and websites to make sure you are comfortable with the ways in which they allow us or other networks to manage your account.

  • When connecting your Limebooth™ account to your YouTube account, you will be able to upload videos to YouTube as well. When doing so, it’s your full responsibility that the video you are uploading abides by the policies of YouTube. Limebooth™ only provides the ability to upload straight to YouTube and has no further responsibility’s what so ever about its content or the way you manage those videos.

  • When placing audio or video online, you must take certain rules into consideration (cf. code of conduct).
 

Information and content that belongs to Limebooth™

All texts, photos, films, images, data, content and structure of the gear database, software, appellations, domain names, brands, logos and other components of the website itself are protected by intellectual rights and belong to Limebooth™. Information that is posted on or offered via this website may not be stored, reproduced, edited, disclosed, distributed free of charge or for consideration, or dispatched in a way that contravenes the intellectual property rights, without the prior, written consent of Limebooth™ and/ or its users.

How to file a report

If you think that your rights are infringed by material that has been posted on our website, you can report such possible infractions using the feedback form at the reporting button (support@limebooth.com), making sure to provide the following information: 

  • Surname and forename.
  • Address and contact details.
  • Identification of the material to which the infringement pertains. The best way to enable us to track the content rapidly is to communicate the URL.
  • A statement in which you make it clear why you think that the material is used in such a way as to infringe copyright or the law.

We shall investigate your complaint and shall remove the material when necessary.

3.   Responsibility

You are responsible for the content that you upload and share with others.

You, or if you are underage, your parents or legal guardian, are responsible for all actions that you carry out on our website. The files that you upload may contain no viruses, have no technical shortcomings and may not damage the operation of computers, servers and the like. 

Only a user with an “Artist” profile may upload videos. Limebooth™ may not be held liable for the content or activities on your personal page. Problems can be reported via support@limebooth.com. 

4. Code of Conduct

Limebooth™ wishes to create a network where like-minded souls can exchange musical experiences in a pleasant manner and expand their horizons.  For these reasons, we offer you an opportunity to post comments, access musical instruments, place want ads, send requests or messages to members, give scores and earn XP points for actions you carry out on the website.  Be respectful and loyal in your contacts with other users and respect the rights of others.

Comments and remarks

  • Unlawful remarks are not allowed.  These include in particular: 
    • Remarks contrary to law and order or good conduct, such as provocations, intimidations, incitement to racism, etc.
    • Wounding, blasphemous or offensive remarks that besmirch the honour or reputation of a person.
    • Placing a recognisable depiction of someone on the Internet without that person’s consent (violation of the right to depiction).
    • Spamming or stalking other users.
    • Infringing copyrights (cf. under Intellectual property)
    • Etc…

Board topics

  • You may not publish or discuss any information regarding your product or services, or future (possible) products or services, or any product or services you are, or have been, associated with. This includes, but not limited to suggesting your own services, or services of partners, clients, employers or friends. You can contact us at support@limebooth.com if you want to advertise your service on limebooth.com.
  • You may not post commission, referral or affiliate links.
  • Cross-Posting is not allowed here. Cross-posting refers to posting new duplicate threads or posts, or the linking to threads or posts already started by the member with the intention of gaining exposure.
  • Boards may not be used solely for promotional purposes.
  • Any messages that are spammy by nature will be deleted.
  • You may not post any message that is commercial by nature.

Account

  • Providing false information or creating an account for anyone other than yourself without permission is not allowed. You are responsible for the content and activity's on your account.
  • You are responsible for maintaining the confidentiality and security of your login data. You are required to immediately inform Limebooth™ of a breach or abuse of login data by sending an e-mail to support@limebooth.com
  • Creating more than one personal profile is not allowed.
  • Gaining access to an account that doesn't belong to you without permission is not allowed.
  • You will not use your account for commercial gain.
  • You may not engage in name-squatting (creating accounts for the purpose of preventing others from using those account names or for the purpose of selling those accounts).
  • You may not use our service for any unlawful purposes or for promotion of illegal activities.
  • When we delete your account, you will not make another without our written permission.
  • Using a twitter or soundcloud account other than your own is not allowed.

People ‘s rights

  • You will respect other people's rights as well as the law and these terms of service.
  • Tagging people that aren't registrated on the site without their consent is not allowed.
  • You will not use our copyrights or trademarks without our written permission.
  • We can and we will remove any content or information that you provide without any notice if we believe that it violates these terms.
  • You may not publish or post other people's videos or personal information, such as credit card numbers, street address or Social Security/National Identity numbers, without their express authorization and permission.
  • Using our profile plugins to make content or information available that isn't yours is not allowed and infringes with intellectual property rights.

Limebooth™ will remove, without prior warning, unlawful messages or information posted on the website which infringe these general terms and conditions and/or the rights of others and the Belgian legislation. A user who does not abide by the rules may be denied further access to the services of Limebooth™. Problems can be reported by other members using the feedback form at the reporting button (support@limebooth.com).

Information and services provided by Limebooth™ on the site  

Information disseminated via banners, buttons, skyscrapers, html pages, flash, photos, videos, blog posts or other media, which is supplied by third parties, does not fall under the responsibility of Limebooth™. Limebooth™ shall, within the relevant legislation, be safeguarded from liability or guarantee for the accuracy, completeness, usability, reliability and topicality of the information on the site and for the consequences of each action/decision taken on the basis of the information provided.

Disturbances, interruptions or failures in the electronic delivery of services requested via our website shall under no circumstances entail entitlement to any compensation. Limebooth™ shall not be held liable for possible viruses either, if such viruses should occur in spite of the precautionary measures taken on the site. Limebooth™ expressly reserves the right to change the information on the site at all times. Limebooth™ may not be held liable for any damage caused by an error and/or omission by its employees and/or subcontractors, or deceptive falsification of data after unauthorised access to the website.

Limebooth™ has taken all measures to remove any illegal information temporarily or definitively or to make it impossible to access such information in the event of a complaint.  A complaint can be filed at support@limebooth.com using the feedback form. Only serious complaints will be investigated.

Links

The Limebooth™ web platform may contain links to other websites or to webpages of third parties because they supply information of interest.  A link to a website of third parties does not however mean that Limebooth™ has any connection with the managers of those websites, or that it cooperates with them or approves the contents of their sites.   Furthermore, such links are not placed only by Limebooth™. The sites of third parties and their contents are not controlled by Limebooth™ . Consequently, Limebooth™ may not be held liable for changes in the content of the sites of third parties. Anyone offended by such links, can use the feedback form of the reporting button (support@limebooth.com) to inform Limebooth™ about the complaint, so that steps may be taken to remove the content and to deny the user further access to the services.

Notice: We may receive commission from sales of products advertised, featured, linked, or written about on this site. 

Removing content

If you think that your rights are violated by material posted on our website, you can report such a possible violation using the feedback form of the reporting button (support@limebooth.com). We shall look into your complaint and shall remove the material when warranted. Only serious complaints will be considered for further investigation. Limebooth™ has the right to remove content from the site that violates the general terms and conditions, the rights of others and the Belgian legislation. 

5.   Sales

Subscriptions

By buying a subscription to Limebooth™ , you agree that you will receive 1 years activation as a premium member for the account you have made a purchase from. Payments are handled PayPal. Following terms shall apply when purchasing a premium account:

  • Premium membership only offers automated features that expand limebooth's usability, personal services are not included.
  • A cancellation with refund can be given within the first 48 hours of purchase. 
  • Premium memberships can not be paused or moved across accounts.
  • Any attempt to fraud or abuse of the premium system will result in permanent suspension of your account.

Payment Services

Limebooth™ is in no case liable for errors and/or negligence relating to the processing of your payment through Paypal.

When payments made through Paypal "bounce" or being reversed,  Limebooth™ is not in the position to clarify the background for reversed payments and will refer the user to his/her bank or selected payment provider in case of such payment issues. 

6.   Disputes

Belgian law shall apply to disputes about the validity, application and compliance with these terms and conditions. Only the Belgian courts shall be competent.

 

7.   Changes to the user’s agreement

Limebooth™ reserves the right to change this user’s agreement at all times. The amended user’s agreement shall be posted on the Limebooth™ site and shall enter into force automatically thirty days after the initial posting on the site. Although Limebooth™ will try to publicise any change, you are nonetheless advised to go over these terms and conditions periodically.

If one or more provisions in these terms and conditions should appear to be partially if at all valid, the remaining provisions shall nonetheless remain intact.

Privacy

Limebooth™ respects the privacy of visitors to its site. To inform you as clearly as possible about the way in which we collect and use your personal data, we have drawn up a privacy policy that contains all the necessary information. Please read this policy carefully before you provide information about yourself.

Account

To gain access to all our services, you are required to open an account on Limebooth.com. The account of someone else may not be used without authorisation. You are consequently responsible for the activity that takes place on your account. If your account is used without your consent, you must inform Limebooth™ at once. 

Personal pages and personal messages

As a user, you have personal pages where you can specify some information about yourself. Here you will be able to add links to other networking sites, use "profile plug-ins" (such as connecting to twitter or Soundcloud), write something about yourself, add your "biography"  and add a picture of yourself. You are responsible for the information and content you provide on these pages. 

Only a user with an “Artist” profile will be able to upload videos. All these pages can be viewed by other visitors to the site.

You may change or remove your profile information at any time. Information will be updated immediately.

As a Limebooth™ user you can send messages to other members via the site. You are liable for the messages that you exchange with other members. Limebooth™ does not intervene in this private communication and consequently cannot be held liable. If a certain member should nonetheless violate the rules of these general terms and conditions by “spamming” for instance, a complaint can be lodged using the feedback form or by sending us an email (abuse@limebooth.com). If this complaint turns out to be justified, Limebooth™ can issue an initial serious warning to the user in question and proceed to close his or her account when necessary.

We may also use information about you that we collect from other Limebooth™ users to supplement your profile (such as when you are tagged in a photo or being followed by other users).

Notifications

 We can send you email notifications when something happens on your account (e.g. when someone comments on one of your video's, when someone starts or stops following you). You can choose when you want to be notified by going to your notification settings on your profile page.

This also means that when you perform a certain action that interacts with another user (e.g. commenting on a video, start/stop following a user, sending a private message), we can send this user a notification using your username.    

 Our policy for minors

We understand that minors are interested in music too. If you are underage, we want to ask you to inform your parents, or your legal guardian, before you provide your data (e.g. by completing your profile) to Limebooth™. They are responsible for you and can warn you about the dangers that the Internet may entail. We advise you to use an alias and to avoid providing overly personal information. Limebooth™ may not be held liable if minors use our services without parental supervision.

 Personal data

For optimal use of the platform, it is necessary for you to create a profile.  When creating your profile, you will be asked to give your name, sex, e-mail address, address, a picture of yourself and a password.  In addition, you must also indicate your profile type (artist / fan), and in case you’re an artist, which type (Vocalist/songwriter/instrumentalist/Dj/producer/dancer). We give you the possibility to provide other data (such as membership in a possible music band, instruments you play, birthdate, biographical data and links to other networking sites).

 Your e-mail address will not be shown on our site and will not be given to third parties. The requested data are essential to be able to make optimal use of the services that we provide and the user options on the website, as well as to be able to contact you if problems should arise.

 When you surf on the site, you provide information which is temporarily collected by us for technical reasons in particular.  Like many sites, we use “cookies” and collect certain information when your browser accesses our site.

 Limebooth™ does not make such data available to third parties on any account, except:

 If Limebooth™ is required to do so by law;

  • If the judicial authorities or police services so request;
  • If such third parties are called upon by Limebooth™ so as to be able to provide the services you have requested.

 In the exceptional case where Limebooth™ intends to pass your personal data on to organisations with which it cooperates, your prior consent will always be requested.

Pursuant to the Privacy Protection Act of 8 December 1992, you have a number of rights concerning your personal data.  The right to inspect entitles you to inspect data that have been collected by the web platform.  The right to correct enables you to improve incomplete or incorrect data.

 Log files, how Limebooth™ uses your information

The web platform also collects information in log files (IP address, browser type).  This information is used for traffic and profile analysis.  In other words, data are here collected on the actions you carry out on our site.

We use the information we collect to provide our services and features to you, to measure and improve those services and features, and to prevent potentially illegal activities.

 One of the primary reasons people use Limebooth™  is to closely follow other likeminded people and to easily connect with one another. To make this possible Limebooth™ provides you with a "'stream" were you can see some recent actions made by the ones you follow or other users on the site. This means that Limebooth™ logs some actions you make on the site and puts them into the "stream". Examples include when you update your status, upload a photo, add gear to your gearlist, upload a video, tag a picture, log in, like a video, receive a reward, make a comment, start to follow a user, write a review, or send feedback.

 Cookie Information

We use "cookies" (small pieces of data we store for an extended period of time on your computer) to make Limebooth™ easier to use, and to protect both you and Limebooth™. For example, we use them to store your login ID (but never your password) to make it easier for you to login whenever you come back to Limebooth™. We also use them to confirm that you are logged in. You can remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use Limebooth™.

 Inviting a friend or band member

When you send a friend - or band invitation using or "invitation form" , we will send your contact a message or email on your behalf using your name. 

 Links

Our site contains links to other websites or to other information. These sites are not under the control of Limebooth™.  We are therefore not responsible for their privacy policy or the way in which they deal with your personal data.  We consequently advise you to have a look at the privacy policies of those sites. When placing a link, you must verify yourself whether this link is not to material or information of suspect origin.  If problems arise from a link to illegal material, we will contact the party that placed the link about it and, where necessary, convey our liability to that party.

 Security

All appropriate security measures are taken to protect your data against, in particular, unexpected destruction, accidental loss, malicious loss or unauthorised access.

 Closing the account

As regards other members, the content of your account disappears and all your personal  data, except the content that had been processed by other lawful users through messages, comments and the like. However, when deleting your account, it may persist in backup copies for a reasonable period of time. These backups, and the content it possesses, will not be available to others.

The processing of personal data by Limebooth™ is reported to the Privacy Protection Commission, Rue Haute 139 Hoogstraat, 1000 Brussels, Belgium,www.privacy.fgov.be.
